"Listed" your sales person may ask you to
accept a Dual Agency Relationship, This is when the sales
associate tries to Represent Both You and a Seller in the same
transaction (Dual Agency). Can one agent serve the best
interest of two opposing sides? Buying a home is no different
than any other transaction; the Seller wants the highest possible
price and best terms and the Buyer wants the lowest possible price
and best terms.

A Dual Agency can legally exist
when the Buyer and Seller give their
informed consent to such an
arrangement. Dual Agents are supposedly able to represent both
parties interests, but are not allowed to counsel or advise either
Buyer client or Seller client in the even that counsel or advice
would adversely affect the other. In other words, dual agents are
not allowed to negotiate for either side and must, by agreement,
remain neutral; But they do know all the financial information and
Motives of both sides. Could this knowledge ever be used
against a Buyer to drive the purchase price up or erode a Buyer's
terms? After all, If the price goes up the agent and the
company receive higher commissions! And by the way, if the
dual agent doesn't provide the same level of services to either
party, as originally agreed, is the fee the same? All too often
Buyers and Sellers receive discount services at full
price.
An alternative solution in
the event you choose NOT to accept the severe limitations of
service that Dual Agency imposes, You could have the Company's
Principal Broker Appoint or Designate a different sales associate to
work with you (Designated Agency). Once again this form of
Agency requires your informed consent. Designated
Agency also has some limitations. One of the caveats of
designated agency is that the sales person who has been designated
to work with you may have previously acquired information about the
seller's financial situation and/or motives for selling. This
sales person would, by law, be unable to share this perhaps useful
information with you.

refer them to an agency that can represent them
